TERMS OF SERVICE
This Terms of Service Agreement (“Agreement”) is entered into between Ksheera Farm, under the laws of India, having its registered office at SY No-164/EE, Ghanpur, Patancheru, Sangareddy, Telangana, 502300 (hereinafter referred to as the “Company”), and the user (“User”, “Customer”, “You”).
By accessing or using the Company’s website, mobile application, subscription platform, or related services (collectively, the “Platform”), you agree to be legally bound by this Agreement.
1. DEFINITIONS
1.1 “Platform” means the Company’s website, mobile application, subscription software, and associated services.
1.2 “Products” mean dairy and farm products including but not limited to Milk, Paneer, Ghee, Curd, Butter, Country Eggs, and related food items.
1.3 “Subscription Services” means recurring delivery services offered by the Company.
1.4 “Applicable Law” means all laws, rules, regulations, and notifications in force in India.
2. ELIGIBILITY
2.1 The User must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872.
2.2 By using the Platform, the User represents that all information provided is accurate and complete.
3. ACCOUNT REGISTRATION AND SECURITY
3.1 The User may be required to register an account.
3.2 The User shall maintain confidentiality of login credentials.
3.3 The Company shall not be liable for any loss arising from unauthorized use of the User’s account.
4. PRODUCTS AND NATURE OF GOODS
4.1 All Products are perishable food items intended for immediate consumption (Please enquire for shelve life).
4.2 Product descriptions, nutritional information, and images are for representational purposes only.
4.3 Natural variations in taste, texture, and appearance may occur due to the inherent characteristics of farm produce.
5. ORDER PLACEMENT AND SUBSCRIPTIONS
5.1 Orders may be placed as one-time purchases or as Subscription Services.
5.2 Subscription modifications must be made before the applicable daily cut-off.
5.3 The Company reserves the right to cancel any order due to unavailability, operational constraints, or suspicion of fraudulent activity.
6. PRICING AND PAYMENT TERMS
6.1 All prices are listed in INR and are inclusive/exclusive of applicable taxes as stated.
6.2 Payments shall be processed via authorized payment gateways.
6.3 The Company shall not be liable for payment failures caused by third-party gateways or banking institutions.
6.4 The Company reserves the right to revise pricing at its sole discretion.
7. DELIVERY TERMS
7.1 Deliveries are generally scheduled during early morning hours unless otherwise stated.
7.2 The User must ensure access to the delivery location.
7.3 The Company shall not be liable for spoilage due to unattended deliveries beyond reasonable time.
7.4 Failed deliveries due to incorrect address or restricted access may not qualify for refund.
8. QUALITY ASSURANCE AND COMPLIANCE
8.1 The Company complies with applicable food safety regulations including FSSAI requirements.

8.3 Allergen Notice: Products contain milk and dairy components.
9. RETURNS, REPLACEMENTS AND REFUNDS
9.1 Due to the perishable nature of Products, returns are not permitted once delivered.
9.2 Refunds or replacements may be granted only in the following cases:
(a) Damaged product at delivery;
(b) Spoiled product at delivery;
(c) Incorrect item delivered.
9.3 Complaints must be raised within six (6) hours of delivery with supporting evidence.
9.4 Approved refunds shall be processed within 5–7 business days to the original payment method.
10. LIMITATION OF LIABILITY
10.1 To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, or consequential damages.
10.2 The Company’s total liability shall not exceed the value of the Product purchased.
10.3 The Company shall not be liable for delays caused by force majeure events including but not limited to natural disasters, strikes, transportation failures, or governmental restrictions.
11. INTELLECTUAL PROPERTY
11.1 All trademarks, logos, branding elements, text, and software on the Platform are the exclusive property of the Company.
11.2 Unauthorized reproduction or use is strictly prohibited.
12. DATA PROTECTION AND PRIVACY
12.1 The Company collects and processes personal information in accordance with its Privacy Policy.
12.2 The Company shall implement reasonable security safeguards as required under the Information Technology Act, 2000.
13. INDEMNIFICATION
The User agrees to indemnify and hold harmless the Company from any claims, damages, liabilities, costs, or expenses arising out of misuse of the Platform or breach of this Agreement.
14. TERMINATION
The Company may suspend or terminate access to the Platform at its discretion for violation of these Terms.
15. AMENDMENTS
The Company reserves the right to modify these Terms at any time. Continued use constitutes acceptance of revised terms.
